Lightpost is a service owned and offered by James David & Company, LLC (JD&CO). By purchasing a subscription you are entering into an agreement with JD&CO, and you acknowledge that you are acting on behalf of yourself and any business you represent, agreeing to the terms outlined below:
1. Welcome to Lightpost!
Lightpost is a custom online service that gives you access to a tool, not a traditional SaaS or software. Each Lightpost profile is custom setup, and tools and features may vary. Your subscription will auto-renew based on the period you’ve selected, and you agree to pay this price for the entire contract period. You can cancel anytime with a 30-day notice after your initial term. Payment is due monthly near the date you first paid.
2. Liability and Refunds
You will use Lightpost to generate and post content to your company websites and social media. Lightpost generates this content for you, but it’s your responsibility to review it before it goes live. You understand we’re not liable for any final results of the content, including text or visual content, and you’re aware we may use third-party integrations to provide this service. Due to the nature of the service, the access you’re granted, and the setup - refunds are not available. Lightpost achieves a great deal for users using A.I, research and posting, which can vary greatly in results. It’s your responsibility to understand what Lightpost offers, and you assume any risk or liability for the final results.
3. Setup and Your Responsibilities
If setup is included, you agree to the varying requirements of adding Lightpost to your social media and website accounts. You are responsible for the timeliness of giving us access. You also understand that if your external accounts are for some reason incompatible from some unforeseen reason, that this does not justify a refund. It’s your job to create, setup, and clearly understand the status and individual requirements of your websites and social accounts.
4. Fair Use of Our Tools
Your subscription or purchase is for your use only. You agree not to copy, distribute, or share the Lightpost system or third-party tools (like Airtable or Make.com). These tools are for your personal or business use only, forever.
5. Payments and Renewals
Payments are due within 7 days of invoicing. Payments renew as per the agreed period. If payment is late, we may pause your access until it’s resolved. Additional profiles, users, and features will be charged on an as-agreed basis.
6. Termination and Marketing
Disputes are handled via arbitration in Utah. You can end your subscription with a 30-day notice, and we’ll store your data for 30 days after termination, then delete it. As a customer, you agree we can mention you as a customer and use your logo in polite marketing unless you ask us not to.
